Should capital punishment be legalised by the Government?

In the People's Republic of China, India, the United States of America and Indonesia, capital punishment is an option given by their legal systems. This allows a jury of 12 people, or in some cases only one (a judge), to decide whether another person deserves to live. Is it ethical that these individuals, who can never fully understand/ empathise with another's moral situation, be charged with this duty. Ideally no man should have another life on their conscience nor should justice institutions permit such outcomes.
